Terms & Conditions.
These Terms and Conditions outline the agreement between Vintage Ice Cream Cart (“the Vendor”) and the customer (“the Customer”) for providing ice cream/gelato services for private events such as weddings, parties, corporate events, baby showers, and other functions within Queensland, Australia.
DEFINITIONS
The ‘Vendor’ is Vintage Ice Cream Cart
The ‘customer’ refers to any individual, firm, or corporation hiring equipment or appoints services from the ‘vendor’.
The ‘Equipment’ refers to all Equipment and accessories supplied to the ‘Client’.
The ‘Event date’ is the day of the wedding or event supplied by the client to the hire company.
1. Conditions of hire
1.1. The hiring of equipment is done on a first to book basis. To secure the equipment for your booking the deposit needs to be paid by the due date given and the term and conditions to be sighted and accepted via the booking form to the Vendor. Should both these not be done by the due date the Vendor has the right to hire any equipment to another client. Hiring of the equipment will begin from the commencement date specified by the Vendor and shall be collected or returned to the Vendor by the date specified by the Vendor. Any extension of the period needs to be agreed to by the vendor and may incur additional fees.
2. Booking Confirmation
2.1. A booking is considered confirmed upon receipt of the required deposit of $200.00 and completion of the booking form.
2.2. The total amount due for services rendered will be outlined in the invoice provided to the Customer prior to the event.
3. Payment Terms
3.1. A non-refundable deposit of $200.00 is required to secure the booking.
3.2. Full payment must be received no later than 2 weeks prior to the event date.
3.3. Failure to pay the full amount by the due date may result in the cancellation of services without refund of the deposit.
4. Travel Fees
4.1. A travel fee applies for events outside Newstead, Brisbane, calculated at $75.00 per hour of travel.
4.2. The travel fee will be clearly communicated to the Customer prior to confirming the booking.
4.3. Travel fees will be charged to the customer at the vendors discretion. This fee will vary depending upon distance traveled from the vendors premises, This fee may be subject to change and will vary depending on the venue location.
5. Deposit
5.1 A non-refundable $200 deposit is required at the time of the booking.
5.2. Final payment of the remaining booking cost shall be paid 28 days prior to the event date. The final payment must be made by the direct deposit into the Vendors bank account and by the due date specified. Please note that should the final payment not be made 28 days prior to the event date the vendor reserves the right to no longer supply any equipment for the event. No deposit will be returned should this occur.
6. Cancellations by the customer
6.1. Cancellations must be made in writing via email to info@vintageicecreamcart.com.au
6.2. Cancellations made 4 weeks or more before the event will be charged 50% of the total cost.
6.3. Cancellations made within 2 weeks of the event date will be charged the full amount of the total cost.
6.4. No refunds will be issued for cancellations made less than 2 weeks prior to the event date.
6.5. The hire company is in no way responsible for intemperate weather that may cause the client to cancel their booking.
7. Cancellations by the Vendor
7.1. The Vendor reserves the right to cancel services at any time for any reason, including unforeseen circumstances.
7.2. In the unlikely event of a last-minute cancellation by the Vendor, the Customer will receive a full refund of all payments made.
7.3. The Vendor will not be liable for any other costs, damages, or losses incurred by the Customer due to the cancellation.
8. Wet Weather Cancellation Policy
8.1. Scope of Policy: This clause applies to any booking of the ice cream cart services where outdoor conditions may affect the scheduled event.
8.2. Right to Cancel: The service provider reserves the right to cancel the booking in the event of wet weather conditions that pose safety concerns or prevent the operation of the ice cream cart.
8.3. Notification: Where possible, the service provider will notify the client at least 24 hours in advance of the event if cancellation is required due to wet weather conditions.
8.4. Rescheduling: In the event of cancellation due to wet weather, the client may reschedule the booking to an alternative date, subject to availability, without incurring additional charges.
8.5. Refunds: If rescheduling is not feasible, the client will be entitled to a full refund of any payments made, excluding any non-refundable deposits as outlined in the booking agreement.
8.6. Client-Initiated Cancellations: If the client opts to cancel the booking due to wet weather conditions, the service provider must be notified at least 8 hours] in advance to qualify for rescheduling or refunds as outlined above.
8.7. Liability: The service provider is not liable for any losses or damages arising from the cancellation or disruption of the event due to wet weather conditions.
9. Event Logistics
9.1. The Customer is responsible for providing adequate space and access for the ice cream cart at the event location.
9.2. The Vendor will arrive approximately 1 hour before the event start time for setup.
9.3. The Customer must ensure that all permits, access, and requirements for operation (if applicable) are arranged prior to the event date.
10. Dietary and Allergens
10.1. The Vendor will provide information about available flavours and any allergens upon request.
10.2. While the Vendor will take reasonable steps to avoid cross-contamination, the Vendor cannot guarantee that products will be allergen-free. The Customer is responsible for informing guests of any potential allergens.
11. Security bond
11.1. The Vendor reserves the right to request a security bond to cover any equipment. The bond and amount will be determined by individual booking requirements. Any damaged, missing, very unclean items will be charged at full replacement cost and/or cleaning cost will then be deducted from the bond amount.
12. Liability
12.1. The Vendor will take all necessary precautions to ensure safety and professionalism during the event. However, the Vendor is not responsible for any accidents, damages, or injuries that occur as a result of guest interaction with the ice cream cart or service.
12.2. The Vendor holds the right to refuse service if any situation arises that may compromise the safety of the Vendor or guests.
13. Force Majeure
13.1. The Vendor shall not be liable for failure to perform any obligation under these terms if such failure is due to an event beyond their reasonable control, including but not limited to acts of war, strikes, or government restrictions.
14. Damage, lost, stolen or unclean equipment
14.1. Upon delivery of the equipment and until the return of the equipment to the vendors premises the client has full responsibility for all equipment hired. The customer will pay full replacement cost of any equipment badly damaged, lost or stolen. The customer will pay any repairing costs to damaged equipment. Any damaged equipment will be decided by the Vendor if it can be repaired or require replacement. Burns, holes, tears, water damage or other similar damage to equipment shall be replaced at full cost to the customer.
14.2. Any equipment returned unclean by the client to the vendor, the customer shall pay the vendor the full cost of returning the equipment to a clean condition.
14.3. The customer shall protect the equipment from the elements during the time of hire. In poor weather conditions storage of the equipment may be necessary and is the responsibility of the client to see that the equipment is stored safely. Any equipment damaged from weather is the full responsibility of the customer and shall be paid at full replacement cost to the vendors.
14.4 The vendors equipment shall be delivered to the Customer in a clean and well maintained condition. It is the clients responsibility to notify the hire company should the equipment not be in a satisfactory condition within 6 hours of receiving the equipment. Otherwise any damage or uncleanliness of equipment shall be deemed the customer accountability.
15. Disclaimer
15.1. The Vendor shall in no way be held responsible or accountable for any injury, death or loss of income caused to the Customer, any third parties or properties due to the hire of equipment or provided services by the Vendor.
16. Agreement to Terms
16.1 By securing a booking with Vintage Ice Cream Cart, the Customer agrees to abide by these Terms and Conditions.
